Welcome to The GAG (The Growth Agency Global) (“The GAG”, “we”, “our”, or “us”). These Terms & Conditions (“Terms”) govern your use of our website www.thegag.io and our services, including web design, web development, SEO, and website maintenance.

By engaging our services or accessing our website, you agree to be bound by these Terms. If you do not agree, please refrain from using our services.

1. About Us

The GAG (The Growth Agency Global) is a professional web development and digital growth agency based in Sri Lanka, providing services to both local and international clients.

Our mission is to help businesses build strong online presences through custom design, development, SEO, and long-term digital strategy.

2. Scope of Services

We offer the following professional services:

• Web Design & Development – WordPress and custom-built websites.
• Search Engine Optimization (SEO) – On-page, technical, and basic off-page optimization.
• Website Maintenance – Regular updates, performance monitoring, and minor bug fixes.

The exact scope of services will be defined in each client’s project proposal or agreement before work begins.

3. Pricing and Package Details

• Prices displayed on our website apply exclusively to WordPress-based projects.
• For custom web development or unique requirements, pricing may vary depending on project complexity, integrations, and timeline.
• Prices listed on our website cover only design, development, and SEO services.

Excluded from package prices (unless explicitly mentioned):

• Hosting and domain registration fees
• Third-party tools, premium plugins, stock photos, or software licenses
• Custom integrations or external API costs
• Maintenance or updates beyond the defined scope

If any additional tools, licenses, or third-party costs are required, the client will be notified in advance and billed separately.

4. Payments and Deposits

To initiate any project, the client must pay a non-refundable deposit equal to one-third (1/3) of the total project cost.

• The remaining two-thirds (2/3) will be divided and paid upon completion of agreed project milestones.
• Payment details, due dates, and milestones will be clearly communicated in the proposal or invoice.
• All payments must be made in the agreed currency and method (e.g., Stripe, bank transfer, etc.).
• We never store or retain your card details. All payments are processed securely via trusted third-party payment providers.

Failure to make payments on time may result in project delays, suspension of services, or termination of the agreement.

5. Revisions Policy

We offer a generous revision system to ensure client satisfaction. Revisions are subject to the selected package:

Revisions are limited to design and content adjustments within the original project scope. Structural or functional changes outside the initial agreement may incur additional fees.

6. Refund Policy

• A 100% refund is available if the project has not yet started.
• Once the project has commenced or design/development work has begun, payments are non-refundable.
• Since payments are milestone-based, clients only pay for completed and approved portions of the project.

In cases of disputes, both parties agree to attempt resolution through mutual discussion before taking any further action.

7. Ownership and Intellectual Property

• Upon full and final payment, all rights, source code, and assets created during the project become the property of the client.
• Until full payment is received, all materials, designs, and deliverables remain the intellectual property of The GAG.
• The GAG retains the right to showcase the completed project in its portfolio, website, and promotional materials unless otherwise agreed in writing.
• Third-party licenses, plugins, and paid assets remain bound by their respective provider terms and are not transferable.

8. Timelines and Delivery

Project timelines depend on scope, complexity, and client responsiveness.

• A clear project schedule and delivery estimate will be provided before commencement.
• The GAG will not be held responsible for delays caused by late client responses, missing content, or third-party dependencies.

9. Client Responsibilities

To ensure smooth project delivery, the client agrees to:

• Provide accurate and complete business details, content, and assets in a timely manner.
• Maintain consistent communication throughout the project.
• Ensure that all content, logos, and images provided do not infringe on third-party rights.
• Review and approve deliverables within the agreed timeframe to avoid delays.

10. Hosting, Security, and Maintenance

• Clients may choose their preferred hosting provider. The GAG can recommend or manage hosting upon request.
• We are not responsible for security breaches, downtime, or loss of data caused by third-party hosting providers.
• After handover, the client assumes responsibility for maintaining the website unless enrolled in an ongoing maintenance plan.

11. Limitation of Liability

While we take every measure to ensure high-quality and secure outcomes, The GAG will not be liable for:

• Losses resulting from client misuse, neglect, or unauthorized modification of the website
• Third-party service interruptions or plugin issues
• Indirect, incidental, or consequential damages arising from use of our services

Our total liability shall not exceed the total amount paid by the client for the project.

12. Termination

Either party may terminate the project agreement with written notice if:

• The other party breaches any material term and fails to remedy it within a reasonable period.
• The client fails to make due payments or communicate for more than 14 days.

Upon termination, all completed work up to that point will be delivered if paid for, and all outstanding payments must be settled immediately.

13. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of Sri Lanka.

For international clients, these Terms also adhere to general global standards of fair business practice for service-based digital agencies.

Any disputes shall be subject to the jurisdiction of the courts of Sri Lanka.

14. Updates to These Terms

The GAG reserves the right to update, modify, or replace any part of these Terms at any time.

Changes will be posted on this page with an updated “Last Updated” date. Continued use of our services after changes constitutes acceptance of the new Terms.
